Patent infringement arises when the subject-matter claimed in a patent has been exploited by someone other than the right-holder, without the owner's authorization or in disagreement with the terms of use.

According to patent law in the country in which the patent infringement has occurred, the owner of the patent may take action in equity or in law such as a patent lawsuit.
